Who needs a rental licence?
If you are looking to rent your apartment, or villa to any person for a short period or long term rental in Portugal, the the law of Portugal states that it is a legal requirement to obtain A Rental Licence / Tourist licence / Rental Permit (Licença de Alojamento Local or Licença de Utilização Turística) The procedure and supplying of the licence offers evidence that the properties are of a criterion which is safe and habitable. The Rental Licence law was implemented by the Portuguese Government in 2008, and will be enforced on all owners of properties available for rental.

The Government of Portugal has established a list of standards that each property must accomplish prior to being viewed as suitable for licencing. These standards may possibly be increased by each individual council further adding criteria to the main list. Each Council (Câmara Municipal) also applies its own cost for the license.
If your property is rented short or long term, whether in the Algarve or in any place in Portugal, you must abide by the new laws and have a touristic Licence. If you choose to disregard this law, you may receive unlimited fines and still have to purchase a licence immediately.

Autoridade de Segurança Alimentar e Económica - (ASAE) In English The Control Authority of Portugal's Economic Activity are already actioning inspections of properties for renting in the Algarve. the department has announced that these inspections will be stepped up substantially between 2009 to 1012 with the aim to have ALL rental properties of any type fully licenced by 2012. Property owners without the compulsory licence (Licença de Utilização Turística) have already received considerable fines on the foundation that their property has been viewed as illegitimate. Rental Agency Companies are also required by law to ensure that all property offered to the public, for rental purpose, is licenced.
